Cancellation Policy:

The guest may cancel anytime outside of 7 days before arrival - a $55.00 cancellation fee applies. The guest will be charged 100% of the total price if they cancel in the 7 days before arrival.

School Holidays/Easter/Christmas Cancellation Policy:

For cancellations made outside of 30 days of your arrival date you will incur a $150.00 administration fee plus credit card surcharges. For cancellations made inside 30 days of your arrival, full payment will be forfeited unless the apartment can be rebooked at the same tariff, less $150.00 administration fee plus all credit card.

Strata Scheme – SP69922 – Owners Corporation BY LAWS

1. Noise
An owner or occupier of a lot must not create any noise on a lot or the common property likely to interfere with the peaceful enjoyment of the owner or occupier of another lot or of any person lawfully using common property.
2. Vehicles
An owner or occupier of a lot must not park or stand any motor or vehicle on common property except with the prior written approval of the owners’ corporation.
3. Obstruction on common property
An owner or occupier of a lot must not obstruct lawful use of common property by any person except on a temporary and non-recurring basis.
4. Damage to lawns and plants on common property
An owner or occupier of a lot must not, except with the prior written approval of the owners’ corporation:
(a) Damage any lawn, garden, tree, shrub, plant or flower being part of or situated on common property, or
(b) Use for his or her own purpose as a garden any portion of the common property.
5. Damage to common property
An owner or occupier of a lot must not mark, paint, drive nails or screws or the like into, or otherwise damage or deface, any structure that forms part of the common property except with the prior written approval of the owners’ corporation.
6. Behavior of owners and occupiers
An owner or occupier of a lot when on common property must be adequately clothed and must not use language or behave in a manner likely to cause offence or embarrassment to the owner or occupier or another lot or to any person lawfully using common property.
7. Children playing on common property in building
An owner or occupier of a lot must not permit any child of whom the owner or occupier has control to play on common property within the building or, unless accompanied by an adult exercising effective control, to be or to remain on common property comprising a laundry, car parking area or other area of possible damage or hazard to children.
8. Behaviour of invitees
An owner or occupier of a lot must take all reasonable steps to ensure that invitees of the owner or occupier do not behave in a manner likely to interfere with the peaceful enjoyment of the owner or occupier of another lot or any person lawfully using common property.
9. Depositing rubbish and other material on common property
An owner or occupier of a lot must not deposit or throw on the common property any rubbish, dirt, dust or other material or discarded item except with the prior written approval of the owners’ corporation.
10. Drying of laundry items
An owner or occupier of a lot must not, except with the prior written approval of the owners’ corporation, hang any washing, towel, bedding, clothing or other article on any part of the parcel in such a way as to be visible from outside the building other than on any lines provided by the owners’ corporation for the purpose and there only for a reasonable period.
11. Garbage Disposal
An owner or occupier of a lot that does not have shared receptacles for garbage, recyclable material or waste must ensure that before refuse, recyclable material or waste is placed in the receptacles it is, in the case of refuse, securely wrapped or, in the case of tins or other containers, completely drained, or, in the case of recyclable material or waste, separated and prepared in accordance with the applicable recycling guidelines.

Special By-law 5 – Smoke Penetration:
(1) An owner or occupier, and any invitee of the owner or occupier, must not smoke tobacco or any other substance on the common property.
(2) An owner or occupier or a lot must ensure that smoke caused by the smoking of tobacco or any other substance by the owner or occupier or any invitee of the owner or occupier, on the lot does not penetrate to the common property or any other lot.

Special By-law 6 – Burning Devices & BBQ’s:
No wood or charcoal burning device of any type are permitted to be used anywhere in the building including owners’ lots and common areas. The only barbeques permitted to be used in common areas are the electric barbeques installed by the Body Corporate. Electric and gas barbeques can be used on lot balconies but not internally within a lot.

Special By-law 8 – Clothes Drying:
The use of appropriate clothes airers are not permitted on balconies facing Manning Street. The drying of towels or clothes over all balcony railing in all areas is prohibited at all times.
Special By-law 9 – Basement Lots:
No person shall allow any object or vehicle to be placed in another owner’s basement car parking lot without the permission of the lot owner. No person shall permit water or any other material or liquid to enter the storage cage or any lot owner.

CODE OF CONDUCT FOR SHORT TERM RENTAL ACCOMMODATION INDUSTRY - NSW FAIR TRADING
Section: 2.5 Guests
Guests to act lawfully.

A guest must not engage in conduct in their capacity as a guest that contravenes:
1. (a) the criminal law
2. (b) planning laws or by-laws (if the premises are in a strata or community scheme)
that apply to the premises
3. (c) the terms of a short-term rental accommodation arrangement for the premises.
Obligations to neighbours
A guest must not at any time during the occupancy period:
1. (a) create noise that because of its level, nature, character, or quality, or the time it is made, is likely to harm, offend, or unreasonably disrupt or interfere with the peace and comfort of neighbours and other occupants of the premises
2. (b) act in a violent or threatening manner towards neighbours or other occupants of the premises
3. (c) act in a manner that could reasonably be expected to cause alarm or distress to neighbours and other occupants of the premises
4. (d) use or enjoy the premises in a manner, or for a purpose, that interferes unreasonably with the use or enjoyment of common property by neighbours and other occupants of the premises in a strata or community scheme
5. (e) intentionally, recklessly or negligently cause damage to premises, any common property or any other communal facilities within the immediate vicinity of the premises, or any public property in the vicinity of the premises
6. (f) intentionally, recklessly or negligently damage the personal property of neighbours of the premises or other occupants of a strata or community scheme. This section is an offence provision under section 54C of the Act.

The Commissioner may issue guidelines about what may or may not be appropriate conduct under section 2.5.2 of the code.
A guest must not copy, or knowingly retain after the end of the occupancy period, any keys, security passes or other instrument that facilitates access to the premises. This is an offence provision under section 54C of the Act.

Responsibilities to hosts:
A guest must take reasonable care of the host’s premises and the host’s property at the premises.
A guest must notify the host or the host's representative of any dispute or complaint about a guest’s or visitor’s behaviour as soon as possible after the dispute or complaint arises. This section is an offence provision under section 54C of the Act.

Exclusion register
A guest who is recorded on the exclusion register is prohibited from entering into any short- term rental accommodation arrangements as a guest.
This section is an offence provision under section 54C of the Act. 15.

Guests responsible for conduct of visitors
A guest is responsible for the actions of visitors they invite onto the premises during the occupancy period and must ensure visitors to the premises comply with section 2.5.2 of this code as if they were a guest on the premises.
